Concerns about rich man’s justice

The High Court has allowed police to withdraw a charge against a man accused of assaulting a woman.

Police prosecutor senior sergeant Fairoa Tararo presented a letter from the victim withdrawing her complaint, a record of a donation by the accused, and a letter from a counselling organisation.

Justice of the Peace John Whitta allowed the charge to be withdrawn, but warned that JPs were becoming increasingly uncomfortable with perpetrators making donations in attempts to have their charges withdrawn.

When victims asked that charges be withdrawn and it took time, they became hostile witnesses and so the case had to be dismissed, he said.

Victims might refuse to come to court and testify in those circumstances, Fararo added.
